1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and AdsAtom Ltd, concerning your access to and use of the https://ga.adsatom.com website as well as any other media form, media channel, or related application. By utilizing our service, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service.

2. Acceptable Use Policy

You agree not to use the AdsAtom platform to:

  • Violate any Google Ads policies or circumvent Google's review processes.
  • Commit intellectual property infringement or generate deceptive content.
  • Attempt to bypass or reverse-engineer the AdsAtom platform or its AI implementations.
  • Share your account credentials or abuse our Free Trial mechanics.

We reserve the right to suspend or terminate your account without notice if we determine you have violated our acceptable use policy.

3. Subscription Terms

AdsAtom requires a paid subscription following our free trial period:

  • Free Trial: We offer a 7-day free trial on all plans. Monthly billing begins automatically after trial unless cancelled.
  • Billing Cycle: Services are billed on a recurring monthly or annual basis, depending on your selected plan.
  • Overage: Exceeding plan limits may require upgrading to a higher tier.

4. Cancellation Policy

You may cancel your subscription at any time through our billing dashboard. Upon cancellation, you will continue to have access to AdsAtom until the end of your current billing period. We do not provide refunds for partial months of service. Following cancellation, your data (including API tokens) will be scheduled for deletion in accordance with our Privacy Policy.

AdsAtom operates entirely via Google Ads API. You agree to explicitly grant AdsAtom access to your Google Ads accounts during initialization. AdsAtom acts as a facilitator; you are solely responsible for ensuring your campaigns abide by Google's Terms of Service and pay all associated Google Ads costs directly to Google.

6. Limitation of Liability

AdsAtom provides AI insights and campaign structures on an "AS IS" basis. We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, or error-free, nor do we guarantee any specific return on ad spend (ROAS) or financial results.

In no case shall AdsAtom, our directors, officers, employees, affiliates, agents, contractors, interns, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages whether based in contract, tort (including negligence), strict liability or otherwise.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Northern Ireland and England and Wales, without regard to its conflict of law provisions.
